The São Paulo Court of Justice (TJSP) determined, in a preliminary decision, the release of a PlayStation 5 blocked by Sony, developer of the video game. The company banned thousands of consoles worldwide, which cost more than R $ 5,000, alleging that users violated the terms and conditions of use of the device. The decision of the São Paulo Justice is unprecedented in Brazil.
Launched just over a month ago, the video game was one of the most coveted - and expensive - gifts this Christmas. With punishment, the device stops working and cannot be used for any purpose.
"It is as if you were accused of violating the terms of use of a streaming service, such as Netflix, for example, and were punished by permanently turning off your television, without being able to turn it on to watch open TV," explained one specialist heard by Metrópoles.
When banning video games, Sony does not provide the reasons and possible violations that would have caused the punishment. In specialized forums, players claim they were banned after using the game access account - similar to accounts on streaming services - on different devices.
In the decision of the TJSP, Judge Anderson Antonucci understood that there was “danger of irreparable damage or difficult repair” in maintaining the lock of the device and determined the reactivation of the plaintiff's access to the console under penalty of a daily fine of R $ 200 limited to the value of the product.
